Judgment was given and probate granted yesterday in the well-publicised case of the mobile phone video will. Reasons yet to be published (they were given ex temp, but his Honour has indicated he intends to publish them), I will post them when they are. See the Courier Mail article here.
A lot of fellow succession law nerds are interested in the wording of the grant. The order that was made was:
“Subject to the formal requirements of the Registrar, a grant of probate of the audio-visual recording, being exhibit 1 in this proceeding and a transcript of which is annexed to this order, issue to the applicant, as executor.”
